The Model Release: What It Is For and What Goes In It
A model release is written consent to the use of a person's image. The document looks like a formality right up until the first dispute, after which it turns out to be the only thing that matters.
What it gives the photographer
The right to use the material in the agreed way. Without a release any publication is technically possible but legally fragile: the person may demand removal, and in most cases the demand will be met.
What it gives the model
Certainty. The document records what may and may not be done, where it will be published and how consent can be withdrawn. Without a release the model depends on the photographer's good faith — and vice versa.
Mandatory points
- Details of both parties and the date
- A description of the shoot: when, where, of what character
- Permitted uses — listed, not described in generalities
- Whether digital processing is permitted and to what extent
- Publication platforms or their types
- Duration and territory of validity
- The procedure for withdrawing consent
- Confirmation of adulthood
Phrasings that devalue the document
«Any use at the photographer's discretion» is a vague formulation that a court reads against whoever drafted it. «Consent to publication» without naming platforms. The absence of a clause on digital processing — today that is critical: a shoot and a synthetic reworking of its output are perceived as different acts.
Storage
The release is kept as long as the material. A paper copy is worth scanning and storing beside the originals — a lost document is equivalent to one that never existed.
